Litigation services

Ross Williams offers a comprehensive service to clients who have opted to go to court themselves or are faced with court action.

We can advise you regarding disputes in the following areas:

  • Employment
  • Land law and trusts
  • Wills and Probate
  • Business and partnership
  • Company and commercial
  • Contractual matters
  • Debt

We encourage our clients to consider alternative dispute resolution - for example, through mediation before or during the court process.

Contractual Disputes
Common examples of a contractual relationship are:

  • Supply of goods and services
  • Partnership or joint venture agreements
  • Agency agreements
  • Distribution agreements
  • Construction projects
  • Loan agreements

Whether you are bringing a case or defending it, we will advise you on your position and on the best course of action. The latter could be a matter of a simple letter from us or a method such as alternative dispute resolution. We will work with you to agree timescales and keep the costs/benefit analysis of the whole process under constant review.

Trusts/Inheritance Disputes
Under the law, an unmarried partner of someone who dies intestate has no automatic right to that person’s estate. The same applies to a same sex partnership where the parties are co-habiting without the benefit of a Civil Partnership. Nevertheless, such partners may wish to pursue a claim for an entitlement to the deceased’s estate. A dependant can also make a claim against a deceased’s estate.

If you are a beneficiary of a will, we can advise you as to your rights and help you to achieve a just resolution. If the only way forward is to initiate court proceedings, however, we will act for you.

Property/Tenancy Disputes
The expansion in the rental sector has led to an increase in the number of disputes between property owner and tenant. Such disputes include:

  • Where a landowner takes or defends proceedings relating to the extent of his/her boundary or rights over his/her adjoining property
  • Where one joint owner of a property requires the property to be sold and the other owner refuses to sell

Cost funding
Litigation can be expensive and so we will always give you the best costs information from the outset. We offer fixed fee consultations together with fixed quotes for certain areas of work. Payment options include payment by regular standing order and by debit or credit card.

Ross Williams offers public funding (previously known as Legal Aid) and has a public funding franchise in Family.
