The purpose of the following paragraphs is to give you some idea of the procedures we follow when buying and/or selling property. BEFORE SIGNING AND EXCHANGE OF CONTRACTS (i.e. before you are legally committed to complete) In a straightforward transaction with no unusual problems arising the procedure (briefly) is as follows (when buying and selling these procedures run simultaneously):- YOUR
SALE
We take your instructions and contact your Estate Agent (if any).
We obtain your deeds from your current Lender.
We obtain up to date copies of your deeds from the Land Registry.
We prepare and send out a draft contract to your Buyer's
Conveyancer.
With your help we reply to all questions raised by your Buyer's
Conveyancer. YOUR
PURCHASE
We take your instructions and contact the Estate Agent (if any).
We obtain a draft Contract (and copy deeds) from your Seller's
Conveyancer.
We send our search to the District Council, re: roads, drains etc.
Some Councils can take up to four weeks to complete the results of
the search.
We obtain your Seller's replies to questions concerning drains,
disputes, rights of way etc.
We receive a written copy of your Mortgage Offer from your Lender. At the same time your Seller's Conveyancer and Buyer's Conveyancer will be carrying out the same procedures for their clients. When all of the above matters are completed and if your Seller and Buyer are ready you will be in a position to exchange contracts (this will legally bind you to them to complete the transactions). At this stage we will ask you to sign your contracts. You should now discuss with your Buyer and Seller the date you would both like to move, bearing in mind that we need, on average, a further 14 days from exchange of contracts to finalise our preparations for completion (see Note). It two or more people are buying together, we will advise as to the methods of ownership i.e. Joint Tenants or Tenants in Common (see attached). Note:
Do not underestimate problems associated with synchronising your sale
and purchase ! AFTER EXCHANGE BUT BEFORE COMPLETION (MOVING DATE) You will now have a date for completion and you should make arrangements with your removal firm and with your Seller and Buyer to have the gas and electricity meters read and the phone transferred etc on completion. We continue with the transactions as follows: YOUR SALE

A
few days prior to completion we shall arrange for you to sign the
Transfer documents and your Mortgage and if necessary ask you to pay our
account.
COMPLETION (MOVING) DAY You should not need to see us on the moving day. Your Buyer's Conveyancer may attend our office and hand over the purchase money. Alternatively and more usually they will telegraph the money direct to our Bank, and we then send your deeds to them. Once your sale has been completed we may attend your Seller's Conveyancer's office (or we will telegraph the purchase money direct to the Seller's Conveyancer) to complete. In any event the deeds to your new home will be handed or sent to us. A key and access to your new property is usually available between 12 noon and 2.30 PM on the date of completion. After completion, we send the Transfer to the Inland Revenue, register your ownership at HM Land Registry and eventually send your deeds to your Lender as security for your loan. This is a short summary of our work. We want you to own a property that you are happy living in and which presents you with no problems of a legal nature when you decide to sell it.
